Terms of Service
Last updated: November 4, 2026
These Terms of Service ("Terms") govern your use of the software, applications, websites, online services and any related content, features and support provided by Scillarium Studio SIA ("we", "us", "our"), together called the "Service".
By accessing or using the Service you agree to these Terms. If you use the Service on behalf of an organization, you agree to them on its behalf and confirm that you are authorized to do so. If you do not agree, do not use the Service.
Specific parts of the Service may have additional terms, and we may conclude separate written agreements with you. If they conflict with these Terms, the additional terms or the separate agreement prevail for that part of the Service. Our Privacy Policy explains how we handle personal information.
1. Use of the Service
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable right to access and use the Service. The Service, including its software, design, text and trademarks, belongs to us or our licensors and is protected by law. All rights not expressly granted to you are reserved.
You must be old enough to enter into a binding agreement in your country, or have the consent of your parent or guardian.
2. Accounts
Some parts of the Service may require an account. You are responsible for keeping your credentials confidential, for all activity under your account and for keeping your account information accurate. Notify us promptly if you suspect unauthorized use of your account.
3. Acceptable use
You agree not to, and not to allow others to:
- use the Service in violation of any law or the rights of others;
- copy, modify, distribute, sell, rent or sublicense the Service or any part of it, except as these Terms allow;
- decompile, disassemble or reverse engineer the Service, except to the extent the law expressly permits it;
- bypass or interfere with security, licensing, payment, usage limits or other technical measures;
- access the Service by automated means or put an unreasonable load on it, except through interfaces we provide for that purpose;
- upload or transmit malware or any content that is unlawful, infringing or harmful;
- remove or alter any copyright, trademark or other proprietary notices.
4. Your content and third-party content
You remain responsible for any content, data, links and sources you add to, access through or process with the Service ("Your Content"). You confirm that you have all rights needed for it and that its use with the Service does not violate any law or the rights of others. You give us the permission needed to host, process and transmit Your Content solely to provide the Service to you.
The Service may let you access content, data or services of third parties. We do not provide, control, check or endorse such content and are not responsible for it, for its legality, accuracy or availability, or for the third parties' terms and practices.
5. Fees and payments
Some features of the Service are paid, as one-time purchases or subscriptions. Prices and conditions are shown before you buy.
Purchases made through an app store or another payment provider are processed by that provider under its own terms, including its billing, cancellation and refund rules. Subscriptions renew automatically for the same period until you cancel them; cancellation takes effect at the end of the current paid period. Unless the law or the provider's rules require otherwise, payments are non-refundable.
We may change prices for future periods. Changes to an ongoing subscription will be communicated in advance and apply from the next renewal.
6. Feedback
If you send us ideas, suggestions or other feedback, we may use it freely without any obligation to you.
7. Changes and availability
We may change, update, suspend or discontinue the Service or any part of it at any time. We do not guarantee that the Service will be available at any particular time or location, uninterrupted, secure or error-free, or compatible with any particular device, software or content.
8. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. YOU USE THE SERVICE AT YOUR OWN RISK.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE, OUR AFFILIATES, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY EUROS (EUR 50).
Nothing in these Terms excludes or limits liability for intent or gross negligence, for death or personal injury caused by negligence, for fraud, or any other liability that cannot be excluded or limited under applicable law.
10. Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold harmless Scillarium Studio SIA from any claims, damages, losses and expenses, including reasonable legal fees, arising from Your Content, your use of the Service or your violation of these Terms or of the rights of others.
11. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if required by law, or to protect the Service, us or other users. Sections that by their nature should survive termination, including sections 4, 6 and 8–14, survive it.
12. Changes to these Terms
We may update these Terms from time to time. The current version is always available on this page with its date. If changes are material, we will make reasonable efforts to notify you in advance. By continuing to use the Service after the changes take effect, you accept the updated Terms.
13. Governing law and disputes
These Terms and any dispute arising from them are governed by the laws of the Republic of Latvia, without regard to its conflict of law rules. Disputes are subject to the jurisdiction of the courts of the Republic of Latvia.
14. Consumers
If you are a consumer, nothing in these Terms limits the rights you have under the mandatory consumer protection law of the country where you live, including your statutory rights regarding paid digital content and services and your right to bring a claim in the courts of that country. The disclaimers and limitations above apply only to the extent that such law allows.
15. General
These Terms, together with any additional terms and separate agreements referred to above, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce any provision is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours in connection with a merger, acquisition or sale of assets. These Terms are written in English; translations are provided for convenience only.
